5.02 Hectares Arable Land, Cliffe Lane, Holme-on-Spalding-Moor
Location – The land is located on the west side of Cliffe Lane, approximately 2 1/2 miles east of Holme-on-Spalding-Moor and 4 miles south west of Market Weighton.
Description – The land extends to approximately – 5.02 (Hectares) – 12.40 (Acres)
The Land – The land is shown as Grade 3 on the Provisional Land Classification Map of England and Wales. It is level and lies approximately 8m above mean sea level. The soil is defined within the Everingham and Holme Moor/Sandburn Series as a stoneless loamy fine sand, well drained, easily worked and well suited to a wide range of arable and horticultural crops.
Basic Payment Scheme – The land is registered on the Land Parcel Information System and is eligible for the Basic Payment Scheme. The Basic Payment Scheme entitlements are included in the sale of the land and will be transferred to the purchaser on completion.
Growing Crops – Field No. SE8338 5808 will be sown with spring barley in the near future.
Development Uplift Clause – There is a development uplift clause in favour of Her Majesty’s Principal Secretary of State for the Home Department for a period of 20 years from 1 May 2001, being a sum equal to 50% of the difference between the open market value of the land immediately before the trigger event and immediately after, payable on the date of one of the following trigger events:
a) the grant of planning permission;
b) inclusion of the property as an allocated site in the Development Plan; and
c) the inclusion of a policy in the Development Plan which benefits the property.
The following forms of development are excluded from the above provisions:
i) use of the site or part thereof as a touring caravan or camping site; and
ii) construction of agricultural buildings or agricultural dwellings.
Ingoing Valuation – The purchaser will be required to pay an ingoing valuation for any seed, fertiliser, sprays and cultivations in respect of a sown crop of spring barley in Field No. SE8338 5808.
No consideration or allowance will be made whatsoever for any dilapidations or other deductions.
Mineral Rights – In the event of the purchaser or their successors in title obtaining planning permission to work any sand and gravel reserves on the land for a period of 50 years from 1 May 2001 the purchaser or their successors in title will be required to pay 50% of the net royalties/sale proceeds achieved to Her Majesty’s Principal Secretary of State for the Home Department.
Nitrate Vulnerable Zone – The land lies within a Nitrate Vulnerable Zone.
Outgoings – The land is subject to drainage rates payable to the Ouse & Humber Drainage Board.
Sporting Rights – The sporting rights are to be retained by the vendor.
Stewardship Schemes – The land is not entered into any Stewardship Schemes.
Tenure – The land is freehold and vacant possession will be granted on completion.
Wayleaves, Easements And Rights Of Way – The property is sold subject to and with the benefits of all rights of way, whether public or private, light, support, drainage, water and electricity supplies and restrictive covenants and all existing and proposed wayleaves and easements for mast, pylons, stays, cables, drains and water, gas and other pipes whether referred to in these sales particulars or not and without obligation to define the same respectively.
If the land is sold in two lots a vehicular right of way will be reserved to the purchaser of Lot 2 from Cliffe Lane over the north boundary of Lot 1.
